Open Question: Tenant or landlord: Who is responsible for unpaid oil bill?

We've had a tenant in our rental house for 6 months. When they moved in, we had a signed service contract with the local oil company for the furnace. I made sure that the contract was "service only", but they told me that I needed to require the tenants to get oil from them. I did not put this in the lease, but the tenant did order oil from them. I got a call today from the oil co. threatening legal action and implying that we owe the unpaid money, because we "guaranteed" that it would be paid when we signed up for the service contract. Of course, I never would have agreed to this. I guess I am a little unclear on the law, because I never saw this in my research on landlord/tenant responsibility in Connecticut. Any thoughts on how to handle this? Thanks. The lease that the tenants signed clearly states that they are responsible for paying all utilities. But the oil company is stating that since we have a service contract (to maintain the furnace, not oil delivery!) that we are also legally responsible for the unpaid oil bills.  more

Open Question: I have a few questions regarding rental law.?

I live in Missouri, I'm in the Army (I ship to basic in Sept). My gf and I and our 3 kids are being evicted and we need to be out by the end of the month. Though there has been no court order as of yet, we are trying to comply to the Landlords request. There is no damage to the place, and no drugs or abuse going on. We paid rent through to the end of April but haven't been able to cover May as we were laid off and unable to find work. My father mailed a rent check to the Landlord, which he in turn refused and sent back. We had painted in the house, we got permission from the Landlord. We painted the living room, hallway, bathroom, and 1 bedroom (various colors). He has after notice of eviction demanded that we paint the trim and doors in the kitchen and the other rooms so that everything is uniform, and if he doesn't he will withhold deposit. The trim and doors that we painted were originally a cream color, and the rest of the places are all wood. It wasn't uniform when we moved in. He also called us on my son's birthday around 2pm and told me to have the place ready for someone to come over and walk around inside to view it. This was 2.5 weeks before we were even supposed to be gone. When this happened we argued on the phone and hung up, he proceeded to call me 15 times the rest of the day into the evening. What kind of things can he hold my deposit for? Can he really make me pay for covering a paint job that he did before I moved in? Not having weeds pulled or lawn mowed perfectly by the time we leave? Can he really do this to all of us even though he refused rent when it was sent to him? Is he harassing us? Discriminating? I don't know what to do...  more

HAWAIIAN GARDENS - Among the 147 Hawaiian Gardens gang members and associates named in five separate federal indictments, some 49 remained at large Friday, authorities confirmed. The search, however, will continue, federal and local authorities vowed. "Operation Knockout has led to federal indictments against 147 gang members, making it the largest gang sweep in U.S. history," United States Attorney Thomas P. O'Brien said Thursday when the indictments were unsealed and the results of the pre-dawn raid were shared with media. During Thursday's operation, a total of 88 defendants were arrested on federal and state charges. Of the 88 arrests, 63 were identified in one of five federal indictments. With 35 defendants already in custody, there are now 98 people ready to be prosecuted in federal court and, if convicted, who will serve at least 85percent of their terms scattered among 118 federal facilities across the country, according to the U.S. Attorney's Office. The remaining 49 defendants named in the federal indictments are either fugitives being sought by authorities or individuals who investigators are working to identify and additional arrests are expected in this case, said Thom Mrozek, spokesman for the U.S. Attorney's Office. Some of those being sought are believed to be in the area while others are suspected to be out of state and out of the country, authorities said. The indictments and subsequent roundup in Hawaiian Gardens - which included 1,400 law enforcement members from federal, state and local jurisdictions - were the culmination of almost four years of investigation into the tiny town's oldest and most notorious gang, authorities said. Varrio Hawaiian Gardens waged a racist campaign to eliminate black people from the community through attempted murders and other crimes, according to the federal racketeering indictments unsealed Thursday. The indictments detailed numerous alleged incidents, including a charge that George Manuel Flores, the lead defendant in the RICO indictment and a longtime member of the gang, allegedly ordered the murder of another gang member who was believed to be cooperating with law enforcement. Flores also allegedly provided a young gang member with a weapon and instructed him to shoot African-Americans who lived nearby, according to the main indictment. Included in the gang's plotting was the murder of Los Angeles County Sheriff's Deputy Jerry Ortiz, who was shot in the head in June 2005 by a VHG member while Ortiz was investigating the attempted murder of a black man in the city, O'Brien said Thursday. It was the cowardly slaughter of Ortiz - a newlywed and father of two sons - that prompted investigators from the L.A. County Sheriff's Department to the FBI to launch "Operation Knockout," O'Brien said. Gang experts and investigators testified at length about the local gang's efforts to remove all black residents from the community during the 2007 trial for the killing of Deputy Ortiz. Convicted killer Jose Luis Orozco was found guilty of Ortiz's murder in the 2007 trial. Ortiz had been investigating the attempted murder of a black man by Orozco when Orozco shot the deputy while hiding behind a door. The victim, who was hired to do some yard work and fix up a vacant rental property, was targeted by Orozco simply because of his race and because he was in Hawaiian Gardens, witnesses testified. My son is 18 years old. His father leased him an Acura TL type S which he has modified. My ex-husband lets my son do whatever he wants. He drives like a maniac on the road and I fear the day a police officer shows up at my door to tell me he's been killed in an accident. Today, my son took his car to the dealership and wanted to get a loaner and go out of town for Memorial Day. He is at risk for not graduating high school this year so I demanded he stay home and study this weekend. The law in my state is that one has to be over 25 to get a loaner car. I called the dealership and told them NOT to give my son the car as he is under 25 and also not to tell him I called but just check his ID. They told me they would this and not give him the car. When I called back an hour later to make sure the car was not given to him, they put me on hold for a minute then without telling me handed the phone to my son who proceeded to use profanity upon profanity on the phone and telling me that they had given him a loaner before finally hanging up on me. My question is, can I do anything about this legally? Considering the fact that they broke the law by giving my son the rental and instead of doing what I asked made more family problems by giving the phone to my son so he knows I called. Is there a state legal dept I can call to report this dealership? Oh and I live in CA, if it matters. I don't want to sue. I want to report it to a govt. agency or a higher up at Acura. It is their company policy. My ex has had to go with him before to it but sometimes they give it to my son. My son, as much as I love him, is living on borrowed time. At 18, he has been arrested 7 times for assault on a police officer, theft, forging checks, and the list goes on. He has straight Ds this semester and is on academic probation. I allow him to live with me b/c I am afraid of what he will do for money if I kick him out. He is verbally and physically abusive to me, his sister, and his girlfriend. We have been to counseling but he always ends up quitting or walking out. Once he became physically combative with the therapist and we were asked not to come anymore. I don't know what to do. I am at my wit's end with him. I just thought that not going out of town this weekend would make him have to study and I know what the dealership did was illegal. I just want to know what to do now. Can anyone give me a # or address in CA to call to report this company?  more

Resolved Question: I was terminated at work for an unjust reason, what can I do?

I was recently let go from employment at a video rental store. This store has always had a high rate of theft and the inventories are never good, I have only bee working there shy of 8 months. I was working my shift where I opened at 9 a.m. the Loss Prevention guy called me in the back around 3:00 p.m. and I didn't leave the office until close to 6:00 p.m. he was interrogating me, trying to make me admit to things going missing. Every time I would try to even answer him he would call me a liar. He was trying to blame me for people renting movies or games and never returning them. People have been doing that forever, it's not my fault. He said that my records were the highest for this occurring, when I tried to tell him, yes because I make the most revenue of any other employee in the store usually double the next highest every week. I kept telling him no and he kept calling me a liar and pretty much that he was going to press charges unless i admitted to doing it. I told him and even wrote it in a statement that rented to people that probably weren't the account holder because, again, that is a normal occurring thing, people will come in and use someone else's account. I wrote also in it that I never rented something to someone or anyone that I knew with the intention of it never returning to the store. BUT he also made me write in it that I am going to pay them $1,100.00. This entire time, my manager wasn't present, but he had her sign the paper saying she witnessed me saying this and saw me write the statement. I feel that I was forced into a false confession because they wanted someone to take the fall. My manager is outraged, she thinks what they are doing is even worse than I do. Everyone at work is, they believe I was a valuable asset to that store. I need to know if what he did was wrong and what my options are... He sat me in an interrogation room pretty much, my manager was present for half the time but they brought another male manager in the other half, so no one heard everything. He made me write and sign a statement that I did not want to write, made me write that I wasn't coaxed or promised or threatened in any way, but I feel I was. I think this is a violation of my 5th amendment rights. The job conditions I worked also, could be questioned, I was never allowed a lunch break, there is usually only 1 person working so bathroom breaks are few and far between when you have customers and you can't leave to get food. I am pretty sure those are violations of labor laws because I have worked over ten hours before with no break, but on average I work 7 - 8 hours. We have to walk to the back at night with garbage alone as well in a not so very nice part of town. What can I do to have this delt with? There is no proof, he said that he can look into records of transactions I did. All that shows is that I rented stuff to people, some using coupons for free rentals, but that happens on a daily basis. There are 6 cameras, none of them ever showing I stole anything. He doesn't even work at the store, he is an LP guy from the other side of the state. They are just looking for people to blame poor inventory on. They are trying to get another guy too, tried to get me to rat him out too. Everyone that work at the actual store and my district manager lover me, I am highest in sells and always bring in ideas for how to get the company more business. I loved working there, that is why I am s mad about it. I was even supposed to take over as store manager at the end of the summer. I know I shouldn't have signed the statement that's what I want the advise over, noone witnessed me write and sign it but there is a witnesses signature. Is that not wrong? I never admitted in the statement to taking anything, can I get a copy of the statement and take to a lawyer?  more

On my rental application I checked the box for criminal past, but did not put detail. The complex found out about past and evicted me. I was told 20 years ago, that after 10 years, I didn't have to put details, am I correct? or is there no such law. My offense was 22 years ago.  more

Resolved Question: Abandonment of Lawful Permanent Resident Status unlawfully obtained?

I am a Canadian citizen and a LPR since 1966. I found myself (blindsided) in a situation where I was merely returning a rental car to the US (after an absence of only 6 days) and then to turn around and go back to Canada for a planned 3 month duration. The officer told me to park the vehicle and come inside because I had to fill out some papers. He made me complete an I-407! He falsely claimed I "...had already moved the majority of my belongings to Canada where he now -lives and works. Subject clearly does not seek to live or work any longer in the U.S." I have documentation to completely disprove his allegation and am now trying to get this ill-begotten I-407 rescinded. I have been out of the country for maybe 8 weeks since 1966. I am now in removal proceedings (Canadian overstayed) in an attempt to get this before an Immigration Judge. Should I ignore trying to get this I-407 rescinded and move ahead with a 'Cancellation of Removal'? Also, Title 18 section 242 "Color of Law" statute would apply, Yes? He did Falsify Material Facts. Does a CBP Officer get extra points on his performance review if he turns in an I-407? Apparently this is not at all uncommon!  more

Resolved Question: Scratched another car. Their insurance charging 4-days car rental R they allowed if not in their policy?

I have asked my insurance company if I am entitled to a copy of their policy and if this is relevant (not going through insurance as less than excess) and they have said it is relevant and I should ask for it. Their insurance company tells me it is not relevant and I am not entitled to it? - I feel I am being taken for a ride as I am trying to handle myself. (they tried to charge me for the fuel in the hire car!) Also the hire car appears to have been kept for one more full day that the date of the repair receipt.....(though there is no clear time in/time out on the receipt) Any advice or links to law/guidelines appreciated.  more

Resolved Question: Law Regarding Property Manager Holding Rent?

I gave my property manager (who manages my rental home) 60 days' notice that I would no longer be using their services. May is their last month that they will collect rent on my behalf. Normally they send me the rent check before the 15th of the month. To date I have not received the rent check. I called the office and they said they did receive rent from the renters, but they are "closing out the account." They said they do NOT know whey they will send me the rent check! Is this legal? I should mention that I am curious if anyone can specifically point me to the laws in California that pertain to this so that I can confront the property manager with the information. How do I get my deposit back from where I use to live? Well my husband and I moved out of our house the 24th of last month and we are still waiting on our deposit. We had to move because my husband is in the military and we got stationed at a new post 2000 miles away from our old post. Well we did not have time for the landlord to inspect the property while we were still in town we had to get on the road because my husband had to report to his new duty station. Anyway it has been almost a month since we have moved out and still no deposit, it was suppose to be sent in the mail. So we called and they said that the ceiling fans were not dusted so the will take some money for that so I was like that is fine. Then about a week later still no deposit so we call again and now the new tenants that live in our old house are complaning about fleas so they want to take money out for that too. Can they do this? I mean when someone else moves doesnt that terminate our lease. I think they will keep coming up with excuses not to give us our deposit. We live there for 5 years rent free. Now that I no longer live there, my niece gave her a rental agreement to sign, and my wife in a rage torn it up, stating that I'm not giving her any money. Resolved Question: Can I question a ticket when the 2 cars ahead of me being waved over by the police continued without stopping?

I was 3rd in a line of cars coming around a blind corner that descends and makes a sharp turn again (which really makes me question the ability to gauge the speed if you looked at the road layout). A police officer immediatelly came out in the road and was making very obvious signs for the cars to pull over, the 2 cars ahead of me just rolled past him and he would turn as they just increased their speed and continued. By the time I past him he was yelling, and like the good law abiding person (who was obviously going the slowest of the 3 because I saw the cop last and was able to take my foot off the accelerator as I came down the hill) I pulled over. He ended up giving me a ticket, meanwhile trucks especially were speeding past us and out of all these speeders another cop waved over a couple obviously in a rental car (I live in Hawai'i) . I'm contesting this, if they are not going to enforce or radio ahead to another set of officers that people are running their obvious directions to pull over, it's just a deterrent and not being enforced across the board. The mph he gave was out of whack as well, this is an area just after 10 minutes of hairpin turns that you are lucky if you get past 25 mph, much less the 35 mph posted, so in less than 100 feet after a 90 degree turn I'm supposed to have gotten up to 58 mph? I read they don't have to show the handheld radar, and seeing how I was the last of 3 cars in a group, how can I be certain that was not the speed of the 1st car before he saw the cop? I wonder if they have the speed showing in the police car/SUV on video seeing how there was both the cruiser equipped with a radar on the side and the cop standing on the side of the road. I'm contesting it, and I'm going to make him admit that he tried to wave over the 2 cars ahead of me and they failed to stop. How do I know if the thing was even calibrated, going to ask for the records showing it had, I'm going to make them work for the $172 they are trying to get form me. gettingoutin2017, I have fought a radar ticket before in MI, and after showing the weaknesses in the officer procedure the police officer got so pissed off in court the judge had to warn him...so you can call me what you want, but I'm not the one stupid enough to even think about that lottery ticket question you asked.  more

Resolved Question: Rental Agreements: One Month or Calendar Month?

My wife and I have lived in our apartment for just over 6 months. (We moved in November 1, 2008.) The agreement is just month-by-month, no lease term or any other requirements like that. We have received a great job offer out-of-state and we really need to jump on it. I have been unemployed, my wife underemployed, and we are paying for the move ourselves. We need every penny we have and more to get us there. We gave our landlord notice in writing in a friendly letter letting him know the situation, most specifically that we need to be there within 2 to 3 weeks. We expressed that we understood that our agreement said we would give him 1 month notice and that if he's unable to fill the vacancy (the only vacancy in the small complex) by one month from now that we would pay prorated to that date next month even though we wouldn't be occupying the apartment. He responded that giving him notice now means that we still owe him until June 30, rather than June 15 because it's a "full month." I don't know much about property law, but I do know that in regular small business law it has to be stated as a "calendar month" in order to be enforced as he's described. Otherwise a month refers to 30 days irrespective of the calendar months. The exact wording from the agreement: "13. TERMINATION. This Agreement and the tenancy herby granted may be terminated at any time by either party hereto by giving to the other party not less than one full months prior notice in writing." If it makes a difference this is in Utah. He also gave us another copy of the agreement (we didn't need another but still) with the section on the security deposit highlighted. "2. SECURITY. The security deposit in the amount of $450.00, shall secure the performance of Lessee's obligations hereunder. Lessor may, but shall not be obligated to, apply all or portions of said deposit on account of Lessee's obligations hereunder. Any balance remaining upon termination shall be returned to the Lessee. Lessee shall not have the right to apply the security deposit in payment of the last months rent. DEPOSIT REFUNDS. The balance of all deposits shall be refunded within two (2) weeks from date possession is delivered to Lessor, together with a statement showing any charges made against such deposits by Lessor." The guy's place is falling apart on its own. We were the first tenants to move in after he remodeled the place, but everything is already falling apart. Caulk is separating, laminate is delaminating, hardwood floors are separating, etc. Even the drywall is separating in high areas completely out of reach. None of this has to do with the way we've lived here. (We are VERY clean tenants.) But I would not be surprised if he tries to keep the deposit to pay for all of that stuff he installed wrong before we moved in. Any suggestions? How can we ensure we get the full deposit back? Is the "full month" wording enforceable to tack an extra 2 weeks onto our amount owed? We can't pay it. We don't have the money to pay that rent and move to the new place. What can he do if we don't? I don't want to have to go through small claims court, but I'm not afraid of it if I have to, but it would have to happen within 2 weeks. I need quick advice. Thank you!  more

My landlords got foreclosed on and the real estate broker offered me a cash for keys deal. It indicates that I need to have the house broom clean, free of all debris, trash, and personal property. My rental came partial furnished however and I don't want most of my landlords furnishings. The real estate broker said that I am still legally responsible for the removal of this property even though the deal says "personal property" specifically. I have contacted the landlord in an attempt to have them get their property but to no avail. I have been searching for laws on this issue but I can't find out if the Realtor is right or not. So am I responsible for my landlord's furnishings as well? Thanks!  more

Resolved Question: What to do about my meddling mother-in-law?

I'm renting out an expensive venue for my husband's milestone birthday coming up. The date of the party happens to fall on my husband's brother's birthday (they're 2 years and 1 day apart). I want a very strict "no kids" rule for this party - there will be booze, potty mouth, and I just don't want them underfoot. My mother-in-law thinks I should make an exception for my husband's brother to bring his kids (10 and 12), since it happens to be his birthday. My brother-in-law also didn't attend our wedding celebration because we had a "no kids" rule then too. So, mother-in-law seems to think I'm ruining my brother-in-law's birthday by asking him to get a sitter for a few hours to attend his brother's big party (since he won't be with his kids). I say it isn't fair to force my husband and I to deal with the years of fallout and drama that's sure to result if we make an exception for any reason (because my brothers and their wives will get their feelings hurt no matter how I explain it). I can't do anything about the fact that my brother-in-law obviously doesn't make my husband's big events a priority, but I still have to deal with these people as my in-laws. They're acting like I'm being totally unreasonable, a child-hating monster. My own mother loves kids, but she sees why it's not appropriate to allow kids there. What's my mother-in-law's problem? She seems to think she can negotiate this, I finally had to just tell her "No" with all the above reasons (and more) today, but she seemed to have an attitude with me after that. Also, my husband is notoriously difficult to buy gifts for. So I asked his parents to contribute to the cost of the rental (less than 1/5 each, just enough to make a healthy dent) as his gift. The rest is coming from me, and, should they choose to withdraw their contributions, I can figure something out. I think she's just too used to getting her way, whatever the cost. And all this arguing took place today, when my brother-in-law doesn't even know there's a party! So all this is her speculation about how he's going to feel. I don't want to cause problems with my new family, but I'm just not going to bend on this one. I'd appreciate some constructive advice, thanks! We've already planned a second, smaller party for the kids and everyone, two weeks later. The party venue also contains a bar/lounge where all the food and drinks will be kept. The management doesn't allow anyone under 21 to enter that area (because it's legally operating as a bar at that point, so it would be illegal) during this type of party. So the children would have to be constantly watched and kept out of that area, couldn't participate in cake, singing "Happy Birthday", etc.. See what I mean about inappropriate?  more

I mailed my landlord a certified document listing the problems within my rental. He hasn't picked up the certified letter at the post office. Per Ohio laws the landlord has to fix the problems within 30 days per they date on the letter. Do this hold true if they don't pick up the document? Note: The problem is I have sewage and water problem in my basement. The landlord acknowledges that there is a problem but claims he doesn't have the money to fix it. Can you still use the information against them if you file a lawsuits?  more

I bought a home last yr and have been renting out 2 of the rooms to friends. I did research on rental laws in my state and had a friend who is an attorney draft up month-to-month contracts for them. They have to give 30 days' notice. Yesterday my roommate told me she was moving out on the 1st of June and was giving me as much notice as she could and hoped I would "work with her." She made it sound like she would be doing me a favor by paying the full 30 days. I will try and fill her space ASAP...but in case i don't, isn't she contractually obligated to pay me for the 30 days? And if she gives me 30 days but has already paid for May, would she just pay a prorated amount for the first 15 days of June? Thanks.  more

I have a rental house that is 4 hours away. I will need to drive down there to meet with the real estate agent and take care of some things and my sister in law and my 8 year old daughter is coming with me since he's out of town. My husband wants me to go up and back in one day- thats 8 hours on the road. I have to pee like every 5 minutes and i hurt if i sit or do anything in one position too long. I just dont want to make the trip in one day. I kinda want to get a hotel room so I can break it up, I know it costs more money but it would make it less stressful on me. Am I being a weiner? here's my situation. i am a college student in florida and I am transfering from a 1 bedroom to a 3 bedroom appt. i put down $900 in deposit and fees. the new rent is $1100, the old is $970 if it isnt obvious the difference is small and the deal is fantastic for an upgrade to a place twice the size. the problem is that these people have forgotten to give me some form's at times. im in their office every day so they work on my lease. and i have given them every shred of income evidence i can find. from my measely 32,000 of college living expense, to my mother's 55,000 a year salary to my parents 55,000 in rent income from other property they own... it adds up to over $100,000 in income. and im still getting the run around. this all comes in the forms of documents from my school, bank statements, parents bank statements, mortgage statements. im surprised they havent asked me for my retirement! my point is, ive had enough. they even called me one day and said if i didnt submit xxx form by 5PM i would lose the deposit... giving me 3 hours to get it done when i was visiting my parents in a city 4 hours away. needless to say i got it taken care of within their "deadline". but it's something that should not have happened at all. im conviced that they are playing games with me so the hold expires and they can lease it to someone else for more. do i have any protection under the law that i can use to hold them to their aggreement? i really want this appartment. is it even legal for them to ask us for our bank statements and my parents morgage statements (which the payments show up on the bank statements)? how much could they possibly ask for? better yet.. any advice?  more

"Just cause" for terminating tenant of government-subsidized housing; The Eviction Process starts with a proper Notice of Eviction and may involve court appearances and a trial. An Order of Eviction may be issued and a court officer or someone from the sheriff's office may remove the tenant and tenant's personal items from the rental property. I recently moved to the San Antonio area for a new job which seemed to be a great new opportunity in my life. Moved here... got a nice rental house and signed a year lease thinking nothing of it. However, nearly three months have passed and the job turned out to be a sham... nothing like they had posted (but that is for another time). I've considered moving back to my home state but I have some questions about the lease. Where I come from (Kansas) lease agreements have an early-termination clause that usually allows a tenant to remove all responsibility before the lease ends typically by paying some kind of fee and a penalty (such as 3x the monthly rent). I looked over the rental agreement with this property and it has an early-termination piece but doesn't really say a whole lot. The lease is a Texas Association of Realtor Residential Lease and the Early-Termination Clause states that the lease can be terminated under Military leave, Family Violence, or by the landlord and/or tenant securing a new tenant to lease the property. I've read in other places that Texas law states that once a notice to vacate (60 day notice typically) is given that the tenant is no longer responsible for any unpaid rent... My question is am I locked into this for the entire term or are there other ways out of this lease? I've tried contacting the property management company but they seem to never return my calls (seems to be a common problem with them). Thanks!  more

My roomate is a NIGHTMARE. She JUST moved in and it's a basement apt. that WE (my partner and I) rent from the landlords (relatives). So basically, we are subletting to her. The room is on a month to month basis and long story short, she's not responsible and a complete disaster. It's just not even worth it to have her as a roommate...it is AWFUL. (I prob will post another detailed thread about this if this one doesn't make as much sense). She wrote part of her rent ($300) and since she owns a business, she put it down as "consultant"..so I was thinking whatever, I don't care what she wants to write the check as. Basically...this isn't a conventional lease...do I need to give her 30 days by law? Nothing was signed and there is no lease. My partner and I are literally aren't able to sleep peacefully in our own place. You can tell her again and again..but she DOESN'T get it. She moved in 2 days before the 1st..and has been here two weeks. I would like her and her cat out by the end of the month (19 days). This is legal correct? I feel like if I don't get her out soon, I'm gonna flip on her..it goes beyond being civil...I've done EVERYTHING. Suggestions? My husband has been working in retail and has been at this one particular store (big European chain - don't want to say the name, but your all familiar) for over a year now. One of the upper management members has moved on and now they need to train my husband for his duties. They want to send him to Philadelphia for a week. Its about 3-4 hrs driving distance. They will not pay for the hotel up front, says we have to not only make the arrangements ourselves, but pay for it and then get reimbursed in the future. I say, NFW!!!! They should not only make the arrangements for him, but pay for it. He was told that if he couldn't pay for it, he would have to drive back and forth each day! that's 4 hrs there, 4 hrs back after an 8 hr day for 5 days. Not to mention the mileage on OUR car since they don't supply him with a rental. I say, this is unethical! I can't seem to find any HR issues regarding this topic. Can anyone tell me (an HR Asst!) if there are any laws binding the company to pay for any travel expenses required for the employment position? Any help you can offer would be appreciated. When my husband and I moved into this house (rental) last July the landlord had never rented a house before. He said that he wanted $925 a month because when he switched the land from his private residence to a rental property the property taxes were going to increase. Well he has proved to be less than an agreeable landlord. He wants us to maintain the property including trimming his massive trees in both the front and back yard. Well over the past weekend my husband noticed that a few very large branches from the front tree were so large they were hitting the house. So he took his ladder and his tools got up there and cut them down so that they wouldn't cause any damage to the house, in addition to those 2 branches there was a large dead branch (nothing growing on it, leaves, anything green at all) Well apparently he didn't want those branches cut down because he called and began to complain about the trimming of the trees. Our neighbor apparently called him and told him we were butchering his tree. So in my efforts to look up city laws regarding landlords, tenants, and city ordinances I came across the property tax information. Apparently he still claims this is his primary residence and is therefore exempt from the property tax increase that occurs when you make your residence a rental. Now I am beginning to wonder what else this prick is doing illegal. How do I report him for the Property tax info. not being correct? Here I have been paying additional money because he claimed renting it was gonna cost him more money when the whole time the property taxes have been going down rather than up due to the property loosing value due to the housing market and economy. Regardless what he is doing is wrong, I need info on what guidlines landlords have to follow regarding reporting to the city/county, laws and regualtions. I already have the prospects but I want to make sure that we have everything we need on paper-- pretty much want to lay down the law and cover my own a&& to be honest. Non-smoker and drinker is one of the primary rules I have --social drinker is alright. I don't want them to feel like it's a double standard but I know when my girl comes out that she will be staying with me but I kinda want to demand that she would be the only exception because I don't want any random sluts hanging out at my place. I cannot find the exact law I am looking for at all. I need some help. I need to know if here in GA it is required for a tenant of a rental house to HAVE to give a 30 day notice prior to moveout..everything I find says to look at the lease. My lease was left blank on the part where it should have been. So what I need to know is that if I go by the lease and send out a notice that I'm moving by the end of this month(which will not be 30 days) that a law here in GA will not override the personal lease between myself and the landlord if he were to try and hold my deposit for this reason. It does NOT say on my lease that I have to give him 30 days. Georgia laws please. No examples of other states, each state has it's own. Specific GA law. I am understanding that I have to refer to my lease for the time it's supposed to be. Where can I even call in my state to find out? I have looked on the GA.gov and can't seem to find what I'm looking for. I found out the answer that I'm looking for. I MUST give him a 30 day notice unless he agrees and signs a "mutual" agreement to let me out early. Which he says he would. The lease would not hold up in the court. The law would override it. Hud finally got my landlord on the phone and he claims he didn't get a copy of the inspection list(which I don't belive, nor does the worker), but by law she has to send it out again and now he says he's willing to cooperate. So that being said, I did call him and actually got him on the phone this time and just asked him to sign the paper to let me out of the property in less than 30 days. He agreed that he would. The Dept. of Comm Affairs told me I had to give him 30 days, that the lease did not matter because of the law. I thought it would hold up, but she said no. Oh well, as long as I can get him to do as he says and sign this paper I don't have to worry about it anymore and just get out of here and let the next tenant deal with him. Voting Question: Is this parking fine legitimate?

I live in an apartment and have a rented parking space. Recently the developer engaged a new agent to oversee parking in our block. They gave out leaflets instructing tenants to pick up their new parking stickers. I did not do so on time and yesterday I found a parking ticket with a fine of £100. I believe this is disproportionate to the alleged offense. I have asked for the decision to be rescinded but the agent remains adamant. I have since looked at my parking rental contract and there is no mention of a parking sticker. I also don't believe that a leaflet or indeed a notice on a wall serves is a legitimate contract. I have also not defaulted on payment for my parking space and therefore did not park illegally. My only 'crime' appears to be parking without the said new permit. I am not entirely conversant with matters of the law but feel deeply aggrieved at what to me appears to be extortion. Do I have a legitimate case? Please please advice.  more

We moved into a house in Washington five months ago, only to discover via a note on our door that its in forclosure. We paid six months upfront when we moved in, and I dont know what the landlord did with that money. My wife recently contacted her ex-husband (divorced 20+ yrs) by leaving a note in a mailbox at a rental property he owns. Voting Question: At fault in accident, can I still receive ticket?

Ok so, yesterday on my way home from work I rear ended another vehicle. I did not want her to contact the police as I know I was at fault and that I would get a ticket. I was in a rental vehicle and apparently the registration the vehicle wasn't for the car I was in. With that being said, she went an called the police since I did not have my correct info. Anyway long story short, we ended up waiting an hour for an officer to show, but no one did. She called back and told the police we were no longer going to wait, but she gave them both of our license plate numbers along with our vehicle descriptions. They told her she could come in and pick up a "walk in" report on Monday (whatever that is) Now my only concern here is, am I still liable to get a ticket since I was at fault and rear ended her (I know the law for New Jersey states whenever you hit someone from behind you automatically get a careless driving ticket). Even though no cop was on the scene or no police report was written on the scene can I still get a ticket from this "walk in" report? Thanks for any help! Resolved Question: Is it possible to break a lease without being held responsible for re-rental costs? (MINNESOTA)?

A friend of mine recently got into a lease in Minnesota. When he signed the lease he was able to afford the unit, however due to income changes he can no longer afford the apartment and wants to move out. He intends to move back to his parent's home and return to school. He is willing/able to give 60 day notice and pay that amount but his lease runs Thru 2/28/10 and there is no way he could continue to afford the payments. We understand the option of subleasing, however this particular complex has many open units so no one has expressed interest in the ad for sublease because they could easily sign their own lease. In the past my leases have included a statement saying if employment was obtained more than 60miles from the rental unit the lease could be broken without fee. Is this a Minnesota law or just the landlord being generous? Any help would be greatly appreciated! I do a lot of Pro Se stuff for myself and others, but I don't know much about rental law. I have a friend who was just given notice by their landlord that their lease would not be renewed. He has been a resident for 7 years. The past 2 months a new neighbor moved in and started complaining about everything possible. The lease expired at the end of April, but they were suppose to get him a copy of the new lease to sign before the end of the month. They told him the lease wasn't ready yet and finally today (May 7th) he got a 20-day notice that they were not going to renew it and gave no cause. Does he have any recourse? I know if NYC there are strict rental laws, but I have no idea what they are here. Can anyone give some advice or take a guess as to any law that state what the deal is either way? Any recourse? FOLLOW UP: If there was a verbal agreement in place and the tenant passed up an opportunity to move already due to the anticipated new agreement, is there no obligation whatsoever on the tenant to rent to a long-standing tenant? My car was rear ended 2 weeks back and the other guys insurance company notified me yesterday that it will be totalled. They will cut me the check for kbb value of my car and will provide a rental car for just another week. Part of the landlord's family was kicked out of there house so he is trying to kick my neighbor out so his homeless kids can move in. He hasn't given a written notice of eviction but he has told my neighbor that he is turning off the power, which the landlord pays for, to the house in three days. The landlord keeps harrassing him verbally about moving out. My neighbor hasnt even lived there a month. Where is the best place on the web to review laws that concern this matter?  more

I have a kind of silly, yet serious question. My rent every month is $1100. According to the eviction papers I just received today, the late charge for overdue rent is only supposed to be $22.90. Since we moved in, we have been charged $1175 for every month that we were late. This is a lawsuit, correct? I do have a leg to stand on in court?  more

When we moved in to our rental property, I didn't notice that it was missing a patio screen sliding door. A month later, I asked my landlord if it would be possible for him to install one, he said that he will not do it because in the past the tenants would always break it and it costs him too much to replace. Is there any law that requires landlords to provide patio screen doors or the frond door screen?  more

I want to rent my 2 bedroom 2 bath townhome in Bloomington MN. Does anyone know how many tenants can legally occupy a 2 bedroom 2 bathroom townhouse in MN. Or where i can find this information. Ive looked online and cant find what im looking for..I have a family of 5 that wants to rent. 2 adults and 3 children ages-Newborn, 2 years and 6 years old. Is that legal in the state of MN. to rent to 5 people in 2 bedroom 2 bathroom townhome? also what about a family of 4 but the wife is 3 months pregnant so they will also have 5 in just a few months..any help would be great.thank you  more
